This Acceptable Use Policy ("AUP") is part of the Merchant Terms & Conditions. It applies to everyone who uses the Waya Service, including your staff and sub-accounts. Breaching this AUP is a breach of the Terms.

تُعدّ سياسة الاستخدام المقبول هذه ("السياسة") جزءاً من الشروط والأحكام للتجار. وتنطبق على كل من يستخدم خدمة وايا، بمن فيهم موظفوك والحسابات الفرعية. ومخالفة هذه السياسة مخالفةٌ للشروط.

1. Lawful use

You may use the Service only for legitimate business purposes and in compliance with all applicable laws of the Kingdom of Saudi Arabia. You must not use the Service for any unlawful, fraudulent, deceptive, or misleading activity.

1. الاستخدام المشروع

يجوز لك استخدام الخدمة لأغراض تجارية مشروعة فقط وبما يتوافق مع كل الأنظمة المعمول بها في المملكة العربية السعودية. ويجب ألا تستخدم الخدمة لأي نشاط غير مشروع أو احتيالي أو خادع أو مضلّل.

2. Data and privacy

  • Only collect and use your customers' personal data where you have a lawful basis under the Personal Data Protection Law (PDPL) and the required consents.
  • Do not use the Service to process sensitive personal data, and do not use customer data (or any inference from it) for purposes your customers were not informed of.
  • Do not upload data you are not entitled to share, and do not misuse, sell, or expose personal data.

2. البيانات والخصوصية

  • اجمع بيانات عملائك الشخصية واستخدمها فقط حيث يكون لديك أساس نظامي وفق نظام حماية البيانات الشخصية والموافقات اللازمة.
  • لا تستخدم الخدمة لمعالجة بيانات شخصية حساسة، ولا تستخدم بيانات العملاء (أو أي استنتاج منها) لأغراض لم يُحَط بها عملاؤك.
  • لا ترفع بياناتٍ لا يحق لك مشاركتها، ولا تُسئ استخدام البيانات الشخصية أو تبيعها أو تكشفها.

3. Messaging and marketing

  • Send marketing or promotional messages only to customers who have given a valid, specific marketing consent, and always include a free and easy way to opt out.
  • Comply with the rules of the Communications, Space & Technology Commission (CST) on commercial messages, including sender identification and do-not-disturb requirements.
  • Do not send spam, deceptive, or harmful content.

3. المراسلة والتسويق

  • أرسل الرسائل التسويقية أو الترويجية فقط للعملاء الذين منحوا موافقة تسويقية صحيحة ومحدّدة، وأدرج دائماً وسيلةً مجانية وسهلة لإلغاء الاشتراك.
  • التزم بأنظمة هيئة الاتصالات والفضاء والتقنية (CST) بشأن الرسائل التجارية، بما في ذلك متطلبات تعريف المُرسِل وقوائم عدم الإزعاج.
  • لا ترسل رسائل مزعجة (سبام) أو محتوى خادعاً أو ضاراً.

4. Security and integrity

  • Do not attempt to gain unauthorised access to the Service, to other merchants' accounts or data, or to any system or network.
  • Do not intercept, scrape, probe, or test the vulnerability of the Service without our written permission; do not bypass authentication, rate limits, or security controls.
  • Do not introduce malware, disrupt the Service, or place an unreasonable load on it; do not reverse-engineer the Service except as permitted by law.

Conduct of this kind — including unauthorised access, interception of data, invasion of privacy, and misuse of information systems — may constitute a criminal offence under the Saudi Anti-Cyber Crime Law.

4. الأمن وسلامة النظام

  • لا تحاول الوصول غير المصرّح به إلى الخدمة أو إلى حسابات أو بيانات تجار آخرين أو إلى أي نظام أو شبكة.
  • لا تعترض الخدمة أو تكشطها أو تفحصها أو تختبر ثغراتها دون إذن كتابي منا؛ ولا تتجاوز المصادقة أو حدود الاستخدام أو ضوابط الأمن.
  • لا تُدخل برمجيات خبيثة أو تُعطّل الخدمة أو تُحمّلها بشكل غير معقول؛ ولا تُجرِ هندسة عكسية للخدمة إلا بما يسمح به النظام.

قد يُشكّل مثل هذا السلوك — بما فيه الوصول غير المصرّح به واعتراض البيانات وانتهاك الخصوصية وإساءة استخدام أنظمة المعلومات — جريمةً بموجب نظام مكافحة جرائم المعلوماتية.

5. Enforcement

We may investigate suspected violations, and we may suspend or terminate access immediately and without prior notice, remove content, preserve and disclose information as required by law, and report violations to the competent authorities, as set out in the Terms.

5. الإنفاذ

يجوز لنا التحقيق في المخالفات المشتبه بها، وتعليق الوصول أو إنهاؤه فوراً ودون إشعار مسبق، وإزالة المحتوى، وحفظ المعلومات والإفصاح عنها وفق النظام، وإبلاغ الجهات المختصة بالمخالفات، كما هو مبيّن في الشروط.
